This would have been avoidable if the plaintiff had reacted in good time to the vehicle entering the motorway with a medium to strong braking. However, this false reaction cannot be charged to the driver of the mobile vehicle, since the defendant himself was too slow on the motorway (Landgericht München, reference number: 19 S 5841/08). How often did I get angry when such a slipper (or creeping Mom) wanted to get on the highway before me. Best to slow down at the end of the acceleration track, instead of gas on the stand strip.
