Dear Forum, yesterday it caught me on the highway from behind… In front of a construction site (the left of three lanes ended) I had to slow down on the middle lane due to the stagnant traffic and an abruptly braking vehicle in front of me to a standstill. At that moment a car opened up to me. The one standing in front of me of course did not notice anything about it and continued his journey. I was on my own; three people were sitting in the driving vehicle. It was clear to the police, but then the driver of the driven-up car claimed that I had stopped abruptly for no apparent reason and that she could not avoid the accident. Neither she nor her fellow drivers could have seen any reason for my braking. The police then was rather perplexed and did not want to determine who was the cause of the accident. Now I am standing there with a dented tail and I have to deal with this matter. Although I think that not every accident will require an RA, I will try one now… Can it be that the driver with a statement that I would have braked for no apparent reason is burdening me with a part or all of the guilt. I do not brake without reason… …especially on the highway! If I had not had the foot on the brake, I might have touched my front man; then at least he would not have been gone… Has i Any experience with what the courts make of such a situation?
