Tach together, the following constellation: – a 13-year-old diesel off-road vehicle is offered for sale at mobile.de. – on the photos a green badge is to be guessed, however, it is removed before sale because it should be deregistered. – Buyer looks at the vehicle, gets vehicle papers sent before, buys the car and both parties agree on a private purchase contract (mobile.de) incl. conclusion of the liability for material defects. At home, the buyer notices that the car does not have a green badge and will not get one either (which turned out to be wrong since the purchase of the vehicle from the dealer at the time, would have been a yellow one). The buyer now wants to withdraw from the contract, since he says he bought the vehicle only because of the green badge. Rightly? I see that so, he had all the vehicle papers before and has de n car also looked at and bought it. WITHOUT badge or other assurances on our part.
