VAT refund Total damage / I think I’m too stupid for it

Hello, I don’t check this with the VAT refund. I have read several threads here on the topic, but still don’t understand it…. To the story: Our passer-by has lost against a bus (self-indebted). The expert of our insurance (full kasko) has the following in the report (total damage): The insurance has opened the following invoice: The amount we got and the wreck sold to the valuer for 5,740€. So far, so good. We then needed one. in Passat bought from the used car dealer for 17,000.00€ (net 14,285,71€) I have sent the purchase contract to the insurance company with the request for a refund of VAT (2,714,29€). Today we receive a letter of insurance by informing us that we will be refunded 317,07€ VAT. Why the amount? Does it not have to be the designated amount? Behind it is printed the note “Rule taxation or option to the rule taxation”. What about the ***** should that be. Does not there have to be VAT?
