I have already comprehensively informed myself about the topic and it is clear to me that no VAT will be refunded on a fictitious invoice and that is also OK. What bothers me about my compensation, that the shipment costs were completely cancelled and after a workshop comparison also the repair costs were clearly shortened. But first of all from the front. My parking car (KIA Rio, built in 2005) was hit by another parking car. The cost estimate is net 1362,41. I then sent the estimate to the insurance company (Aachen Münchner, GENERALI) together with the damage report. Shortly afterwards a deposit of 800€ was transferred to me and it was said that the remaining amount will be paid after an examination was completed. Almost a month later a new letter from the insurance company arrived. The 2nd amount consists of the calculated repair costs (933.74€) plus a flat fee (25.00€) less the 800€ already reimbursed. Overview: Costs calculated according to estimate: 1362.41 Costs calculated (insurance): 933.74 Difference: 428.67€ What exactly has been shortened: Spare parts: ca. 28 € Additional costs: ca. 172 € (delivery costs completely deleted) Wage: ca. 66 € Painting: ca. 161 € As far as I have read the Verbri I also assume that ATU is not a comparatively expensive brand workshop and that the costs for spare parts are also to be reimbursed in full. I do not find the compensation paid appropriate. Should I, in your opinion, contact a lawyer who knows about it?
