Judgment: A left turner is liable even if he has a straight-forward red light lighter

I cannot understand the verdict below. In my opinion, the behaviour “it has only just become red, I can still drive” is still supported by the judge. Another one drives with red, went against basic rules of road traffic and the left-wing turner has to carry part of his damage himself. Well then, what comes next. A left-wing turner adheres even if he clashes with a straight driving red light lighter. According to the judgment of the Oberlandesgericht (OLG) Frankfurt, a motorist must comply with the rules – even if another one violates them. A left-wing turner must observe the advance of vehicles, especially if there is no separate traffic light sign for left-wing turners (Az.: 22 U 67/09). The court lifted a decision of the Landgericht Darmstadt with the judgment and sentenced a motorist to carry part of his accident damage himself. The left-hand turner claimed that the other had gone to the intersection at high speed when the traffic lights already showed “red”, so he had to compensate for the full damage. The district court had divided this view and sentenced the opponent to full compensation. However, the OLG judges saw a considerable co-inflict with the left-hand turner, who therefore on half of his damage si However, the ORG decision is not yet legally binding.
