Good day, last week I bought a used car. And when I was with it today with a body builder, almost the blow hit me. Now it turned out that he probably had a set-up/damage on the left side, whereby the complete sill has rusted through to the interior. At the inspection this looked by far not so bad. Also from the accident on the left the buyer knew nothing of course. Today a body builder has the repair costs a uf 2.400€ estimated, because one has to flex the complete threshold, and also pieces from the underbody. Now I wanted to know from you whether one can hope for a compensation / division of the calculation on the part of the seller? In the purchase contract nothing of the accident is left. Only “underbody left rust”. But not a word about the threshold. This is due to the interior & endangers the strength of the vehicle according to the words of the body builder. In addition, in the purchase contract stands the following clause: “Excluded from the liability for defects in property, the vehicle is sold unless a guarantee is given below. This exclusion does not apply to claims for damages arising from defects in property, liability based on a deliberate or grossly negligent violation of seller’s obligations, as well as in the case of injury to health, life and body. ” Except for the case with completely rusted threshold, the seller also kept the following secret: the radio is only off & too unfunctioning _(so it is also in the purchase contract)… Have the car been working for almost a week and the radio has worked exactly 1x. The navigator is not working at all. What can I do now before the famous 2 weeks has expired? I would be very grateful for your help, as I am slowly despairing….
