Hello together, I’m busy just the following topic: At the end of February someone drove me in a parking lot frontal into my car (2003 BMW 318ti compact, good condition, M sports package, 156T km) because curve cut. The car has now some deep scratches on the bumper, but otherwise ready to drive. The insurance from the accident opponent (100% guilty admission) sent a reviewer to me in the company 2 days later and this one inspected the car on the company parking lot. Resulta t: – repair costs: 3.019,29€ (incl. VAT) – Merchantial impairment : none – repair time: 2 working days – replacement value: 2.800,00€ – residual value (acc. to enclosed offer): 1.001,00€ – replacement time: 9 working days Now the insurance paid me 1.829€ and gave me 3 days time to submit the car according to this offer, then I would get another 1,000€. I rejected this offer in writing, because I can not just give my car within 3 days. This offer has now been extended to 05.04. My new car, which has already been ordered, will only come in August. My questions: – Is the car an economic total damage? I mean to have heard somewhere, only when 130% of the vehicle value has been exceeded, it would be a total damage. – Since I (allegedly) cannot be economically better after the accident (according to insurance) than before the accident, the insurance does not want to pay the repair costs without VAT. Wouldn’t there be a way? – Would a peer review be appropriate? Who pays for it? Ciao and Happy Easter
