Guarantee only at the place of sale

Quoted from the ICZ (IserlohnerKreisAnzeiger) of 26 March 2011 According to a judgment of the OLG (OberLandGericht) Koblenz MUST a vehicle purchased e.g. on the Internet be repaired also with the seller (!)! Because, if a guarantee is granted, this usually applies only at the place of the seller. In the present case a buyer had bought a vehicle from a customer a vehicle train from a dealer in the Koblenz area and subsequently found serious defects. But since the dealer did not react to the different defects, he wanted to return the vehicle. But the dealer refused to do so! He justified the refusal by not having the opportunity to remedy the defects himself. In the present case, self-collection of the new car was agreed with the dealer near Koblenz. Thus, the “place of performance” was also with the dealer and there would have also the warranty claims Many car buyers, no matter which car brand, should not be aware of this fact. Of course, it is tempting to save a few hundred or even thousands of hours. Only the disadvantages do NOT outweigh this supposed advantage if, as described above, there is a guarantee case and a return is excluded, because the repair was carried out in another workshop, or, in the case of a complaint of defects, that vehicles are NOT present at the dealer’s premises.
