Opposite insurance deducts costs after estimate and does not want to pay

Hello together! I would like some advice from you. I had a slight contact with another motorist. The police investigated on site partial debt 50/50. Did run stupidly, but happened. The other person involved had their damage settled through my insurance. So far, so good. My vehicle is a 5 year old VW with an existing used car guarantee. At the request of the opposing insurance I have to create an estimate read This is because I want to fictitiously calculate the damage. I am therefore the VW contracting partner and have had a cost estimate drawn up there. For me only one VW contracting partner is eligible for the estimate (existing used car warranty and warranty for the vehicle, since only 5 years old). In the case of a repair by a foreign operation or a “backyard workshop” is generally rejected any culant. Here Volkswagen AG sets a repair by a vehicle. Now I receive the letter of the opposing insurance with confirmation of the fictitious invoice, however with a deduction of say and write 445,42 Euro net ! Here the reasons: – The painting and the associated de- and assembly of the attachment parts is not absolutely necessary for lacquered chemical reasons. According to manufacturer guidelines, the painting specialist can only decide bindingly, whether a coating is a co-painting Deduction: 40 units of time = 79.20 Euro – The quoted spare parts prices contain an extra charge of on average 10% on the manufacturer’s recommended retail price. Such surcharges do not belong to the required manufacturing effort, as not every workshop calculates these surcharges. Only against corresponding proofs / repair invoices can the additional costs caused by the surcharge be reimbursed. Deduction: -155.81 E uro – shipment costs can only be incurred if the repair company has to transfer the vehicle to an external workshop (e.g. paint shop) and additional costs are charged for this. Since it is not proven that these costs actually arise, shipment costs are deducted in the fictitious invoice. Deduction: 66.00 Euro – wages: The following reference companies are qualified specialist companies for carrosserie and paint shop. The quality standard of these companies is regularly checked by an association or certification body. The damage can be completely and professionally corrected there, the quality of the repair is equivalent to the brand-linked specialist workshops. Original spare parts are manufactured in the region of the vehicle owner. They meet the highest requirements for equipment and qualification and ensure a high-quality repair according to the manufacturer’s guidelines. In addition, these workshops offer a generally free pick and bring service. Wage factors / hours: Mechanics 105,00 Euro Electrics 105,00 Euro Lacquer incl. lacquer material 152,25 Euro Reference plant used: – Here is the name of the company – The reference plants listed are within the meaning of the BGH judgement of the 2nd court. 3.02.2010 – VI ZR 91/09 for qualified master plants, in which a professional and according to manufacturer guidelines high quality repair is guaranteed. It is ensured that the quality standards of the plants is checked regularly by an association or a certification body. Only original spare parts are used and the plants grant on all carried out carrosserie and painting work a at least 3 year warranty. Due to the modern The equipment and extensive experience of the selected repair companies is ensured that the necessary work on the vehicle in question can be carried out equivalent to a brand-linked repair shop. This can also be derived from the fact that the brand workshops, which do not have their own car body department and/or paint shop, regularly use the named plants in the subcontract. If I order a free workshop or a paintr to paint my vehicle, I am the client. If the VW contracting partner of the same workshop issues the order for a paintwork, then the contract workshop is the client. However, the contract workshop is my contact person or guarantor. Above this contract workshop stands the Volkswagen AG, which only takes care of the requirements of the customer. If I give an order to a free, untied workshop, then it was with kulanz or the like. If this free workshop then suddenly broke, then it was that…. I am at the end of the stupid. Is that actually right, that an opposing insurance requires me to drive to which workshop I have to go? Furthermore, it is right that, due to the reference to a free workshop almost 500 euros net from the K Is it the HUK COBURG, which I would like to mention!
