Overtaking highway

The following situation: highway, 3-lane. Driver drives on the middle lane, speed between 120 and 130 km/h. On the right lane a truck, behind a caravan team. The driver is overtaking, arrived in the middle of the caravan team it pulls over without blinking. Driver has to avoid and pulls on the left lane. After making sure in the mirrors nothing was visible. Suddenly next to the driver another vehicle has appeared, which was not visible before. According to the driver, she arrived at about 200 km/h. Both parties then stopped. Then a third car (witness) arrived, who said he had seen everything exactly and claimed that the driver who moved over was definitely to blame and he would report it. On a factual description that one had to avoid the caravan he did not react. The two cars did not touch each other. According to the witness, the driver also did not touch the guardrail, but there was a sign that one had to avoid the caravan. Damage to their vehicle. However, no such noises could be seen or is questionable if you are able to continue straight ahead when in contact with the guardrail and speed 200… What can happen? Thank you. Hage
