Hello together I bought a new car yesterday for the first time from an EU importer. During the sales meeting, at the delivery (with witness) on the website of the dealer and on the invoice I am assured a 3 year warranty (Suzuki). However, the checkbook was missing. The seller said he did not know why this was not there yet and he immediately wrote an e-mail in my presence, in which he demanded this. In the situation there I wanted to na secure the door and let me confirm in writing that the checkbook including stamped delivery inspection will be delivered as soon as possible, approx. 3 weeks. And I also had a witness with me. So, now I have read something on the Internet and now it makes me quite a stomach ache. The guarantee first motivated me to buy a new car instead of a higher-quality used one. I still have one advantage: I didn’t have to pay for the car at all! He gave me a transfer note with the invoice, which I should actually pay no later than Monday. What would you advise me to do? My thoughts go back to the car and pay the purchase price only if he can give me the stamped checkbook? I will then lose (if he can really deliver the checkbook) some weeks in which I probably have to pay the car insurance further. We need the car in the weeks n other consideration: to hold back part of the purchase price. But can I just do that at all? Can I return a car that, unlike the contract concluded, has no guarantee and insist on one with guarantee? Or can a price reduction be enforced? Luckily I have a legal protection insurance, which I can only reach on Monday. And since the topic no longer goes out of my mind and I could hardly sleep at night, I ask you here for your assessments / advice. Thank you!
