  • Dealer buys cars and finds a defect later (allegedly)

On Friday I bought a new car from a local dealer who bought my old car in return. He had the opportunity to look at the car before, which he did. Now he just wrote me why I hid a hail damage from him. The car was always under the roof and if I had seen one, I would never have hidden it. Normally I would think my part and be good, maybe he just wants some more money intoxicated. But the problem is that I’m going to get money from him by bank transfer, because my old car was worth more than the new one and I now have my concerns that he’s going to transfer the money to me so easily. The financial is all calculated up to the cent, about any flaws etc. nothing was contractually recorded. No clauses, not fine print, just like names and addresses of dealers and me, purchase price of new car, purchase value of old car, amount of the I’m gonna get our autographs. I don’t want to have any stress with him just because I don’t like stress.

  • Car bought, now engine damage

Hello, had bought a car private last week, 5300 euros. On the way home lights oil lamp and motor lamp. Vehicle turned off , again turned everything back on normal. But the engine also made funny noises at home and the oil lamp came back. Seller wrote, then of course the usual, knows of nothing. Excluding the liability for defects etc. is in it. At the Dursicht of the documents we suddenly saw that we happened to take both purchase contracts with us. U. What are our chances?

  • VAT fraud on export to EU abroad when selling as a company?

The following scenario: I sell a car (value about 43000 Euro). Car belongs to a company. Must actually show VAT when selling. Now comes a potential buyer (let’s say from Bulgaria) and wants to buy the car. Since it is an export, I can sell it without VAT. The potential buyer is a dealer and sends me all the data. Trade register extract and its foreign (EU) VAT ID. I checked this and this also fits to the indicated Da He wants to pay me to the bank and the cash (without VAT about 36000 Euro) to my account. I would write him an invoice without VAT with reference to export “Internal tax-free delivery” Now the following fraud scenario: The buyer pays the car with his private money. The company serves only as a reason to save the VAT. He then sells the car for 43000. Makes 19 percent profit. His company never sees the money and the car. it flies up and I may pay the VAT (on the sum I have received)

  • Private Sale Arglist Deception Rights Seller

I sold my 17-year-old VW with a mileage of approx. 217000km, pointed to certain defects (I am not an expert) and meant he should come through the TÜV without major problems. the buyer made a test drive and looked at the vehicle. In the contract of mobile.de stood, the sale is under exclusion of material defects liability. Now the new owner sent me an estimate of the cost of his VW-Autohaus-Werkstatt with a horenten sum, and demanded from now the purchase price refund, because he did not expect such high TÜV costs and now makes me responsible. on the cost estimate there are among others positions like HU-main investigation, dekra service, inspection, oil change, … I am not responsible for this after all? Furthermore, these are mainly wear parts (EZ 2002, 217,000km) which in my opinion are no defects. He also accuses me that I did not let the vehicle look through in a workshop before I sold it. (Who does that?) Now, if I don’t transfer the money, he wants to sue me for an arrogant deception. Does he have a chance with it in court?!

  • AMG and co “only for export”? What is this about?

Hello MT, again and again I come at mobile.de to actually very expensive cars which are offered for a mock price. For example GLE 500 Coupe for 31,000€ or an M2 comp. for a similar course. The mileage is always very low and optically the cars look like new. But then always stands there “only for export” According to Google are such vehicles with which the dealer is afraid to give, but this always refers to old cars with extremely high mileage and a completely different But what about these almost new cars? Are they really close to exitus and very expensive repairs would have to be done? Maybe someone knows that?

  • Damage to the cash-in settlement before handover

Hello, my MB dealer has promised me contractually for my Polo 3.200. Suspected damage to the control chain has been known. Now, on the penultimate way from the bank (credit agreement for new ones signed) home has guaranteed one (motor control light on, speed no longer matches speed). If I just did not drive with it anymore, unfortunately no alternatives. 🙁 In other threads here it is advised not to start the engine again. What ra Did you ask me? Dealer Monday to drag the car? To drag it yourself? Any tips? Got a protection letter at the Huk, but they want it in a contract workshop, I don’t have anything of that.

  • Car sold privately! Now I’m accused of being fraudulent!!!

Moin people! I would like to hear your opinion on the following issue. Maybe someone has already experienced a similar case: Just 2 months ago I sold my vehicle to private. The car was from 2004 and had 230,000KM. (Automatic gearbox) I used purchase contract from mobile. (without warranty, liability for material defects etc.) I told the buyer right at the first conversation that he did not have to expect a new car when visiting. I used the car every day for 4 years to get to work. (only 6km back and forth) I didn’t have an inspection, oil change, etc. in the 4 years. The car always ran perfectly. The buyer came, looked at the car, made a test drive and was enthusiastic. After he made a deposit, he picked up the vehicle 2 weeks later. Until then I used the vehicle daily. On the same day of the pickup he called me and told me that at full throttle (kick down) a transmission error message appears in the display. After turning off the engine everything is ok again until the next kickdown. The ”normal” driving is possible without any problems. Since I don’t have too much idea of it, I only said that such a mistake did not happen to me in 4 years and he should possibly make a transmission flush. Now I received mail from his lawyer. The buyer either calls back the full purchase price, or a compensation of 1,500€ since I received the According to his lawyer, an expert report is now being prepared which will prove exactly this. I honestly think it is difficult. The fact is that I never had such an error message because I never moved the vehicle with full throttle. How do you see it? Do I have something to worry about? According to his workshop, there is an accident in the car. Let’s go to the ”coupling” in the automatic transmission. Exchange gearbox 5,000€ !!! Do I see this wrong, or should one not expect certain wear and tear phenomena at 230,000KM ??? For your answers I am very grateful. Greetings!

  • After car sale: Buyer wants to charge rockfall over my insurance

Hello all, I have sold my car registered (the buyer will cancel it next week). The car had a rockfall in the field of view (also deposited in the purchase contract and thus signed by both parties). Now he wants to pay my insurance number, the deductible and thus have a new windshield installed. Is that right at all? So far I have not pulled out insurance data from me. Ask for short-term answer. E.

  • Car from Germany to Austria in Corona times

Hello, since I had a car accident I now need a car again. Then I got a little inquired and found out. Now my question: Does someone have experience how it currently runs by car pick up, cross border, what do I need to get no problems? How about it when I’m back in Austria? Thanks & Greetings!

  • Sell logged in to export dealers?

I would probably sell my car to an export dealer, I don’t think I get more than 500€ anymore, since I currently have two cars, I won’t give it in payment for another one like the last time. Can I trust with an export dealer that he also quickly unsubscribes the car (he advertises regularly in the newspaper and that for years). I didn’t have space to leave the car standing unregistered. I read that I have the car with a copy of the purchase I would give the dealer the car and tell him that I will have the car insured one more day, I would inform the insurance company in advance. In addition to the purchase contract, I would write a letter that the dealer undertakes to unsubscribe the car promptly. Opinions/recommendations?
