  • Loss of earnings after damage to civil liability for sole proprietors

    6 (!) months ago I had an unindebted traffic accident. The insurance company (HUK-Coburg) has paid all invoices until now, except for my loss of earnings. So far, in similar cases, each insurance company wanted proof of the earnings of the last 90 days before the accident. After deduction of VAT and 30% variable costs saved (petrol, oil, etc.) the net amount per workshop day was paid. I think that means “Bergerische Formula”? Every 4 weeks come ne ue completely senseless demands, e.g. the VAT invoices of the last 3 (!) years and now still the VAT pre-registration and income declarations for 2015 and 2016 (!!). The clerk now has no idea at all. The sad thing is, I have a “traffic” lawyer. Unfortunately, he does not act according to my mind and passes the inquiries of the insurance only to me. So I do his work. Unfortunately, you can not order a new lawyer without The legal protection only pays one lawyer. I wanted to know now whether someone had a similar situation and how he solved it? Or whether someone knows a verdict where the liability insurance has also made excessive demands and been expelled into their limits. I would also be helped by the wording of the “Bergerische Formula” or judgments where it was mentioned. I thank you for reading the many text, but it’s a shitty feeling that makes to be in contact with these insurance companies and, unfortunately, with some lawyers.

  • Taxi concessions in Germany “unconstitutional”

    One question: I am at home in Austria and with us the highest courts have already overturned the requirement test for taxi industry (ratio numbers) twenty years ago. No one has to pay more money for a business license for taxi today except the applicable fees of approx. 100 euros per certificate. If I search for a concession for 100 taxis in Vienna today I will get it if the access requirements are met. Currently Euro 5 standard. d have to pay for a taxi concession to get one when one got free because someone had covered it. That was considered unconstitutional by the Supreme Courts. A taxi operator filed a complaint at the Supreme Court because he did not get a concession and the court gave him the right. What does a taxi concession cost to you? These are illegal undeclared payments anyway. At that time we had 3600 taxis in Vienna and today it is 4600. So 1 Is the Federal Republic of Germany not part of the EU because EU law does not apply? 4 Freedoms in the European Union such as freedom of establishment etc. In Austria there is only a need test for pharmacies and the arms trade.

    Hi, I’m 22, I’m at the beginning of my studies and I’ve tried almost every job for which you don’t need any qualification. I don’t need success: pizza driving, call center, waiters.     Unfortunately I do this myself almost every working day, because time is money… I work as an employed taxi driver in Hamburg and Ystad (I earn 40% of the daily turnover net).Inner city max 10-15 km/h too fast Outer town max 20 too fast Highway max 30 too fast 99 % passengers say nothing… but is that okay at all?   • TAXI personnel’s behaviour towards customers and vice versa

    Meal !!!!!! I have been working as a dispatcher (telephone and radio) in our headquarters for almost 10 years now. In the last 1-2 years I have noticed that the relationship between the taxi staff and the clientele is getting more and more tense. Say: Aggressivity/Streiterein, Abzockerein of all kinds, disrespect for the other and and and and increase in my opinion continuously. And indeed from both parties !!! To be honest, I wonder why d is that so? Is this also true in other service sectors?? Have you ever had trouble with the taxi staff (driver/head office) or with the customer? And if so, why????
